Session Policies & Terms

Introduction

These Terms of Service ("Agreement") govern the portrait photography services ("Services") provided by Audrey White Photography ("Photographer") to you ("Client"). By booking a session, you agree to the following terms.

Booking and Payment

  • A signed agreement (when applicable) and any required session fee or retainer are due at the time of booking to reserve your session date.

  • The remaining balance is due on or before the day of the session unless otherwise agreed in writing.

  • Images will not be delivered until payment has been received in full.

Rescheduling and Cancellations

Rescheduling

  • Requests to reschedule must be made at least 24 hours before the scheduled session whenever possible. Rescheduling is subject to Photographer availability.

Cancellations

  • Cancellations made less than 24 hours before the session may be subject to a cancellation fee of up to 25% of the session fee. Exceptions may be made at the Photographer's discretion.

Weather

  • Outdoor sessions may be rescheduled at no charge due to rain, severe weather, unsafe conditions, or other circumstances that would negatively affect the quality of the session. Cloudy conditions alone generally do not require rescheduling and often provide ideal lighting for portraits.

During the Session

Arrival Time

  • Please arrive on time. Late arrivals may reduce the length of the session in order to accommodate other scheduled appointments.

Cooperation

  • The Client is responsible for ensuring that all participants arrive prepared and cooperate during the session. The Photographer is not responsible for missed images due to late arrivals, lack of cooperation, or failure to follow reasonable direction.

Children

  • Parents or guardians are responsible for supervising children at all times during the session.

Safety

  • The Photographer will never ask clients to participate in poses or activities that are considered unsafe. Clients are responsible for their own safety and should immediately notify the Photographer of any concerns.

Image Selection and Delivery

  • Final edited images will typically be delivered within two weeks of the session unless otherwise communicated.

  • The Photographer will select and edit the best images from the session. Unedited RAW files are not included and will not be delivered.

  • Basic retouching and color correction are included. Requests for extensive retouching or digital manipulation may incur additional charges.

Copyright and Image License

  • All photographs remain the copyrighted property of Audrey White Photography.

  • Clients receive a non-exclusive, perpetual personal-use license to download, print, and share the delivered images for personal, non-commercial purposes.

  • Images may not be sold, entered into contests, used for commercial advertising, or altered beyond normal cropping or resizing without the Photographer's written permission.

  • Commercial licensing is available upon request.

Portfolio and Promotional Use

  • Unless otherwise agreed in writing, the Photographer may use images from the session for portfolio display, website galleries, social media, studio samples, competitions, exhibitions, and other promotional purposes.

  • If the Client prefers that their images remain private, they must notify the Photographer in writing before the session. Every effort will be made to honor that request.

Model Release

  • Any use of images for promotional purposes is subject to the model release signed by the Client or the parent/legal guardian of any minor participant.

Photographer Liability

  • If circumstances beyond the Photographer's control—including illness, emergency, equipment failure, severe weather, or other unforeseen events—prevent the session from taking place or images from being delivered, the Photographer's liability is limited to rescheduling the session or refunding any amounts paid.

  • The Photographer maintains liability insurance and will be responsible for damages resulting from the Photographer's negligence.

Limitation of Liability

  • The Photographer is not responsible for poor image quality resulting from factors beyond their control, including but not limited to weather conditions, venue restrictions, participant cooperation, clothing choices, or lateness.

Governing Law

  • This Agreement shall be governed by the laws of the Commonwealth of Massachusetts.

  • Any disputes arising under this Agreement shall be resolved through mediation prior to litigation whenever reasonably possible.

Changes

The Photographer reserves the right to update these Terms of Service. The version in effect at the time of booking shall apply to the Client's session.

Agreement

By booking a session with Audrey White Photography, the Client acknowledges that they have read, understood, and agree to these Terms of Service.
